Are Texas homebuyer rebates legal?

Yes. Texas does not prohibit real estate agents from sharing their commission with buyers. Under TREC rules, licensed brokers may return a portion of their earned commission to a buyer as a closing credit. Our program is operated under EXL Realty Group (TREC Broker License #9015220). How much cash back do I get, and what's your fee?

2.5% cash back, statewide, no tiers. We keep a flat 0.5% fee; the rest of the builder-paid commission is returned to you as an estimated closing credit subject to lender approval. Full in-person representation is included at no extra cost: Jakir attends all builder meetings, reviews purchase agreements and all addenda, and negotiates upgrades, lot premiums, closing cost contributions, and rate buydowns on your behalf. The estimated closing credit is typically the 3% commission minus our 0.5% fee, returned at closing subject to lender approval.

Can the estimated closing credit be used for a mortgage rate buydown or builder upgrades?

Subject to lender approval, the estimated closing credit can be applied to: closing costs, a mortgage rate buydown, builder upgrades (structural or design center selections), or lot premiums. Each lender has its own limits on how closing credits may be used: discuss your options with your lender early in the process. We work closely with your lender to structure the credit in the most beneficial way for your situation.

Why do I need to register before visiting a builder model home?

Builder policies commonly require your buyer agent to be identified before or during your first model-home or sales-office visit. The on-site sales representative works for the builder, and many builders will not add an outside buyer agent after an unregistered visit. Registration takes about 2 minutes and is free. It identifies Jakir Malek of EXL Realty Group as your buyer agent before that first visit. Builder policies vary, so contact us if you have already visited.

What is included, what you handle, and when to involve us.

What does the service include?

Every buyer gets the same service, statewide, at the same flat rate: buyer-agent registration, required brokerage documents, transaction paperwork, contract and addenda review, negotiation support, in-person builder meetings where available, commission processing, and the estimated closing credit. Our fee is a flat 0.5% of the purchase price, subject to the signed representation agreement.

Can I contact the builder or community directly?

Yes. You may contact builder sales teams and communities directly. Register us as your buyer agent first and identify Jakir Malek of EXL Realty Group whenever a builder asks whether you are working with an agent. Do not rely on a website inquiry alone to preserve eligibility under a builder's policy.

Do I have to sign a buyer representation agreement?

Yes. A written agreement documents the brokerage relationship, services, compensation, and estimated rebate terms. Review it before signing and ask questions about anything you do not understand. Website registration begins the process but does not replace the final signed agreement.

What if I already visited a builder without an agent?

Contact us as soon as possible. Some builders may allow late registration, while others will not. We can ask the builder, but we cannot guarantee that it will recognize outside representation or pay buyer-agent compensation after your first visit.

How the new-home search works and what to confirm with a builder.

Where does the new-construction inventory come from?

Our inventory is compiled from builder-provided market inventory files and organized by metro, city, builder, community, price, address, and available property details. It is not an MLS or IDX feed.

How often is the inventory updated?

We publish updated builder inventory as new market files are received and reviewed. Availability, pricing, incentives, completion dates, and specifications can change between updates, so always confirm current details with the builder.

Why do some homes have limited details or no photo?

Builder inventory files do not always include bedrooms, bathrooms, square footage, floor plans, or licensed photos. We display the information provided and avoid using third-party listing photos without permission. Contact the builder or community for the latest plan details and approved media.

Is a home shown in the search guaranteed to be available?

No. The search is a discovery tool, not a reservation system. A home may be sold, placed on hold, repriced, or changed after the latest update. Confirm availability and terms directly with the builder, then tell us which home interests you.

Can you help with a builder or home that is not in the inventory search?

Usually, yes. The program is not limited to homes visible in our search. Send us the builder, community, address, or website link before visiting, and we will review the location, service availability, and registration requirements.

Which Texas markets are included?

Our primary inventory markets are Dallas–Fort Worth, Houston, Austin, and San Antonio, including surrounding cities and communities. Our flat 2.5% cash back may be available elsewhere in Texas; contact us with the builder and location so we can confirm.

How estimates are calculated and what can change the final credit.

How does the savings calculator work?

The calculator uses the home price and an assumed buyer-agent commission to compare the estimated credit after our service fee. It is an illustration, not a promise. The actual amount depends on compensation offered and received, purchase price, signed agreement, transaction terms, and lender approval.

Is a 3% buyer-agent commission guaranteed?

No. Buyer-agent compensation is negotiable and varies by builder, community, home, promotion, and transaction. Any website example using 3% is an estimate only. We confirm the applicable compensation and rebate terms for your transaction.

Can I keep the builder's incentives and receive a rebate?

Often, but builder promotions and lender conditions vary. Ask the builder for a written incentive sheet and provide it to your lender and buyer agent. The builder, title company, and lender determine how incentives and credits may be combined.

When and how is the rebate provided?

The rebate is normally disclosed in the transaction and applied as a closing credit when permitted. The final method and amount must comply with the contract, builder, title company, lender, and applicable rules. It is not paid before the brokerage receives the related commission.

What happens if the lender limits the closing credit?

Loan programs may limit credits or how they can be used. Tell your lender about the anticipated rebate early. Depending on the transaction and approvals, the parties may explore eligible closing costs, a rate buydown, or other permitted uses, but no particular treatment is guaranteed.

Do I owe a fee if the builder does not pay buyer-agent compensation?

Your signed buyer representation agreement controls compensation obligations. Before you proceed with a builder, we will explain the known compensation and discuss any gap or exception so you can make an informed decision. Do not rely solely on an online estimate.

Do DFW builders honor buyer-agent rebates?

Yes. Major DFW builders including D.R. Horton, Lennar, Highland Homes, Bloomfield Homes, David Weekley, and Taylor Morrison cooperate with registered buyer agents. The critical requirement is that you register Jakir as your agent before your first visit to a model home or sales office. Once you visit without an agent registered, most builders lock you out of outside-agent representation.

Which DFW communities have the most new construction right now?

Collin County leads DFW new construction: Frisco, McKinney, Prosper, Celina, Anna, and Melissa all have extensive inventory from national and regional builders. Denton County communities like Northlake, Aubrey, and Little Elm are growing rapidly. Tarrant County (Mansfield, Midlothian, Aledo, Burleson) and Rockwall/Kaufman County (Rockwall, Royse City, Forney) also have strong inventory. We cover all of these.

Do I get full buyer representation in DFW?

Yes, and it works the same way here as everywhere else in Texas: a flat 2.5% cash back with no separate service tier for DFW.
